1. Area of application
1.1 Exclusively the following conditions are valid for the duration of the business connection - also for those from future business transactions - for all orders, deliveries and orders. The customer recognises this for the being given and all future contracts exclusively as for him obligingly, even if in order writing and order writing is pointed out according to form to own shopping terms or conditions of the contract and their validity is determined. Following terms of business have precedence before concerning the contents divergent conditions of the customer. The renunciation of the customer of the validity perhaps of own terms of business is also not removed by our delivery. A divergence of the following conditions needs in particular cases our written confirmation.
1.2 The ineffectiveness of single regulations of the following conditions leaves the effectiveness of the remaining regulations untouched.
2. Offer
Offers are always not-binding. Completion of the contract and other arrangements becomes first by our written confirmation obliging. The confirmation immediately occurs, however, at the latest two days after order. As far as specialists, sales employee or sales representative meet verbal additional agreements or deliver assurances which go out the confirmation of order, these always need of our written approval.
3. Payment terms
3.1 The customer releases the DENAS-CZ s.r.o. from any liability which arises from not proper payment of the sales tax or from resort in or foreign tax authorities because of omitted sales tax submission of the customer.
3.2 The payments occur bar, by precash or on calculation. Foreign orders occur exclusively by precash.
3.3 Orders on calculation are to be performed within one week on receipt of the product freely cashier's office exclusively on our bank account given on the calculation.
3.4 With excess of the agreed payment interest is calculated at the rate of 5% of the invoice amount.
3.5 The customer can only charge or assert a restraint right if his demands are ascertained indisputable or legally.
3.6 Disregard of payment terms or circumstances which are likely to diminish the creditworthiness of the customer entail the immediate maturity of all our demands. In addition, we are entitled to require pre-payments for still being open deliveries as well as to withdraw after adequate extension from the contract or to require compensation because of non-fulfilment, to prohibit the wide disposal of the product further the customer and not yet to fetch back paid-up product at the expenses of the customer.
3.7 Because the company DENAS-CZ s.r.o. is in Czechia, they provided by deliveries directly from the company DENAS-CZ s.r.o. all calculations for private individuals with 9% USt. Commercial buyers with VAT number may make purchases in Czechia to the 0% of VAT.
3.8 The customer outside of European Union don´t pay the EU VAT and have therefore a discount. Both invoice and delivery addresses must be outside of European Union.
4. Terms of delivery
The agreed term of delivery is not valid as a firm bargain for the purposes of the Civil Code, provided that expressly suitable written arrangements were not met. If we cannot keep to the agreed term of delivery, the customer has to grant an adequate extension. From the shop assistant disturbances to be represented in the business concern, in particular labour disputes, cases of higher power, losses of production also in the company of our presupplier, do not extend the delivery time accordingly. We don´t ship the devices to USA, CANADA and Australia.
5. Retention of title
We reserve ourselves the property in the object of delivery up to the entire payment of the purchase price. If the customer is a businessman, in addition, we reserve ourselves the property in the object of delivery up to the full fulfilment of all to us against the customer from the whole business connection to being entitled claims under inclusion of any return.
6. Fault rebuke and guarantee
6.1 Guarantee time begins with the delivery of the product with the receiver and amounts 24 months.
6.2 The receiver has to examine the received product immediately after arrival for amount and assured qualities. He has to reprimand evident defects within one week in text form (letter, phone, fax, eMail) to us.
6.3 With entitled objections finishing touches of faulty product or spare delivery or exchange occur after our choice.
6.4 The guarantee does not apply to such damages which originate with the buyer from natural wear, injurious surroundings influence, high-handed remachinings and improper treatment as well as intervention of third.
7. Cancellation right and right of return
7.1 A cancellation right becomes to a consumer, so every natural person who acts in the business dealings for purposes which cannot be added of her professional or commercial activity, put away by law.
7.2 The cancellation must contain no grounds and is to be cleared in text form (e.g., letter, fax, eMail) or by return of the product towards the enterpriser. For the term protection the timely sending is enough.
7.3 The cancellation term begins with the delivery of the product with the receiver and ends after two weeks.

7.5 If the price of the thing to be sent back does not exceed an amount of 40 euros or if with a higher price of the thing the consumer has not produced the consideration or a hire-purchase at the time of the cancellation yet, unless the delivered product does not correspond of the ordered ones, the regular costs of the return are imposed on the consumer by contract.
7.6 Not free returns are not accepted by us and decrease to loads of the customer in this.
7.7 We take back medical devices exclusively unused and in close original packaging.
8. Data protection right
8.1 The customer agrees with the fact that personal data are stored for the treatment and processing and evaluation in our enterprise and are transmitted within the scope of the usual treatment in parts into three parts (e.g., to presupplier).
8.2 The customer is able to do any time free of charge information about the data stored to his person (extent, purposes) ask and extinguish this, correct and for the purposes of the advertisement or market research or public opinion poll allow to close.
